Terms of Use - Endole

1. Agreement

1.1 This document is an agreement ("Agreement") outlining the terms and conditions for the use of website Endole.co.uk ("Services"), including but not limited to its services and products provided therein.
1.2 The Agreement is between the Customer ("Customer") accessing the Services and Endole Limited ("Endole"), a company incorporated under the laws of England and Wales (registered number 09346879) and having its registered office at 153 Lodge Road, Birmingham, B70 8PJ.
1.3 By accessing or using the Services, you acknowledge and agree to be bound by this Agreement. If you do not agree to this Agreement, you must cease use of the Services immediately.
1.4 Endole reserves the right to update, modify or replace this Agreement at its sole discretion without prior notice. We recommend and encourage you to periodically review this Agreement for changes. Your continued use of the Services following the posting of any changes to the Agreement constitutes acceptance of those changes.

2. Use of the Services

2.1 In order to access certain products and services provided by the Endole, you will be required to provide certain information about yourself as part of the registration process. You agree that any information you provide about yourself to Endole will always be correct, accurate and up to date.
2.2 You agree to access and utilise the information, services and products provided by Endole only for purposes that are permitted by the General Data Protection Regulation ("GDPR") and any applicable law, regulation or generally accepted practices in your respective country.
2.3 If you wish to transfer any information, services or products provided by Endole, you agree to transfer only in accordance with the GDPR and any applicable law, regulation or generally accepted practices in your respective country.
2.4 You agree not to access any of the information provided by Endole by any means other than through the various interfaces that is provided by Endole and the Services.
2.5 You agree not to access the Services through any automated means, including but not limited to, the use of automated scripts, web scrapers or web crawlers except in the case of search engine crawling.
2.6 You agree that you will not engage in any activity that interferes with or disrupts the web servers hosting the Services and any networks connected therein including but not limited to excessive usage, requests, or downloads.
2.7 You agree not to create, register, or utilise multiple user accounts, distinct identities, or temporary email addresses for the purpose of securing multiple free trials, promotional offers, or introductory access to the Services. Free trials are limited strictly to one per Customer, and any attempt to circumvent this restriction shall be deemed a material breach of this Agreement.

3. Fair Usage

3.1 The subscription platform and associated web interfaces ("Platform") are provided subject to fair usage to ensure stable performance, server security, and equitable access for all Customers.
3.2 Web subscription plans are intended for manual, human-driven search and data retrieval through the standard Platform interface. Subscriptions do not include, grant rights to, or substitute for automated programmatic data delivery, which is provided exclusively through separate, paid API licenses.
3.3 Customer usage of the Platform—including page views, search queries, company profile views, and manual data exports—must remain within reasonable limits consistent with normal human business operations and the specific allowances of the Customer’s subscription tier.
3.4 Endole reserves the right to monitor account activity and request volumes on the Platform to identify non-standard usage, automated interactions, or account sharing.
3.5 If, in Endole's reasonable opinion, the Customer’s platform usage exceeds normal human capacity, utilizes unauthorized automation, or places an unreasonable burden on the Platform infrastructure, Endole reserves the right to:
3.5.1 Temporarily restrict, throttle, or rate-limit the Customer's account access;
3.5.2 Require the Customer to transition to a paid API plan or appropriate enterprise subscription; or
3.5.3 Suspend or terminate the Customer’s account pursuant to Section 7.

4. Acceptable Use of B2B Data & Information

4.1 By accessing and using Endole’s platforms, products, or dynamic enrichment APIs to retrieve business information, corporate records, or professional contact details ("B2B Data"), you agree to strictly abide by the following data use rules.
4.2 All B2B Data provided by Endole is intended strictly for business-to-business (B2B) purposes. You may only use this information for legitimate corporate due diligence, market research, identity verification, credit risk assessment, and targeted B2B direct marketing aimed at corporate bodies (such as Limited Companies, PLCs, and LLPs).
4.3 Endole acts as a data aggregator and search platform. Once you view, export, save, or otherwise process B2B Data from our platform for your own business purposes, you become the independent Data Controller of that information under the UK General Data Protection Regulation (UK GDPR). As the Data Controller, you are solely responsible for ensuring your subsequent use of the data is lawful.
4.4 Endole does not send, initiate, or facilitate electronic communications on your behalf. You are entirely responsible for ensuring that any sales outreach, email marketing, or direct communications you conduct using Endole data fully comply with the Privacy and Electronic Communications Regulations (PECR) and the UK GDPR.
4.5 You explicitly agree not to use Endole’s services to send unsolicited electronic direct marketing to individual consumers, sole traders, or unincorporated partnerships without first obtaining their prior, explicit consent as legally required by PECR.
4.6 When utilising B2B Data for direct marketing to corporate entities, you must legally ensure that:
4.6.1 Your identity as the sender is not disguised or concealed in any way;
4.6.2 Every communication contains a clear, visible, and functional opt-out or unsubscribe mechanism;
4.6.3 You maintain and strictly honour your own internal suppression list of individuals or businesses who have objected to your marketing.
4.7 You agree to fully indemnify, defend, and hold harmless Endole Limited, its directors, and employees from and against any claims, fines, penalties, damages, or legal actions brought by third parties or regulatory bodies (such as the Information Commissioner's Office) arising from your misuse of the B2B Data or your failure to comply with applicable data protection and electronic marketing regulations.

5. Payments and Refunds

5.1 All payments made to Endole are processed by our Payment Service Providers, PayPal and Stripe.
5.2 Due to technical reasons and unforeseen circumstances, Endole cannot guarantee your orders will be processed immediately. However, Endole takes all necessary steps to ensure your payment is processed as quickly as possible. In most cases, payments are processed within minutes and the purchased products will be made available to the Customer via the Website.
5.3 Unless you cancel your subscription before the end of your then-current billing cycle (monthly or annual), your subscription will automatically renew for a successive period of the same duration.
5.4 By starting a subscription, you authorise Endole (via our payment processors, Stripe or PayPal) to automatically charge the applicable recurring fee to your chosen payment method on each renewal date until you cancel.
5.5 You may cancel your subscription at any time through your Endole Account settings or by contacting customer support. Cancellation will take effect at the end of the current paid billing period.
5.6 Refunds are processed at Endole's sole discretion. Endole reserves the right to refuse a request for a refund however a valid reason will be provided to the Customer upon refusal.

6. Money Back Guarantee

Endole offers a Money Back Guarantee ("Guarantee") to customers who are unhappy with their purchase. The Guarantee is subject to the following terms and conditions:
6.1 The Guarantee can only be applied once per Customer. Customers are expected to review their initial purchase before committing to any further purchases.
6.2 You will receive a refund of the exact amount of your purchase, subject to any deductions outlined in clause 6.5.
6.3 For the Guarantee to be applicable, it must be invoked within the specific timeframes outlined below:
6.3.1 Within 7 days of purchase for monthly subscriptions.
6.3.2 Within 30 days of purchase for annual subscriptions.
6.4 Customer cannot be in breach of any terms and conditions outlined in the Agreement.
6.5 The Guarantee is strictly conditional upon credit usage. If any included credits have been utilised during the guarantee period, Endole reserves the right to reduce the refund amount proportionally to the volume of credits used, or void the Guarantee entirely at its sole discretion.

7. Termination

We reserve the right to terminate access to the Services with immediate effect if:
7.1 The Customer fails to pay any undisputed payment due on the due date.
7.2 The Customer commits a breach of any of the terms under this Agreement.

8. Warranty and Liability

8.1 The information, products and services provided by Endole is provided on an "as is" basis without any guarantees, conditions, or warranties as to its accuracy, whether expressed explicitly or implicitly.
8.2 Endole shall not be liable for any loss or damage incurred including but not limited to loss of income or business revenue to the Customer or any companies or entities connected with the Customer as a result of using the services provided by Website.
